Like Ads on Facebook Can Be Challenged in Court

Mark Zuckerberg was clearly hoping they would win the point, but now a judge has ruled that the situation with Facebook regarding its Like button can proceed if anyone wishes to make a case in this way.

The Like button has been controversial since it was first introduced earlier this year. It may be more than just controversial – it may also be against Californian law. The law states that no one can use another person’s likenesses in order to make commercial gains. The Like button could be construed as breaking this law and while those in charge at Facebook were clearly hoping to win at this early stage, they must now accept that other people can take them to court if they so desire.

The judge’s ruling means that any such case can be brought before the courts if so desired. A spokesman for Facebook stated, perhaps predictably, that they feel the case is “without merit”. It remains to be seen whether the courts would rule in the same way.

This is not the first time Facebook has fallen foul of officialdom in recent months. The Federal Trade Commission recently ruled that Facebook had breached privacy laws and the social media site must now keep it up to date with its actions. It remains to be seen whether Facebook will win any future court action regarding the Like ads, but it is just one more step in potentially the wrong direction for the site.
